General questions

How much does a consultation with a lawyer cost?

Fees for consultations and other services are calculated under the official Tariff for Attorneys' Fees and Costs. You will know the exact amount for your case before the first meeting, with no surprises.

What should I bring to the first meeting?

All documents related to your case: contracts, decisions, judgments, summonses, letters and correspondence. If you are not sure what matters, bring everything — we will identify what is relevant together.

I have been summoned for questioning by the police or prosecutor. What should I do?

You have the right to defence counsel and the right not to answer questions until you have consulted a lawyer. Call as soon as possible, before the questioning, so we can prepare.

Do you represent clients outside Belgrade?

Yes. The office is in Belgrade, and we represent clients before courts and authorities throughout Serbia.

How long do court proceedings take?

It depends on the type of proceedings, the court and the conduct of the opposing party. At the first meeting you receive a realistic estimate and options for resolving the dispute faster, for example through settlement.

Is a conversation with a lawyer confidential?

Yes. Everything you tell a lawyer is protected by attorney–client privilege — even if you do not retain the office.

Criminal law

Do I have to give a statement to the police?

No. A suspect has the right to remain silent and the right to a defence lawyer before and during questioning. It is best to consult a lawyer before the interview.

What is a plea agreement?

It is an agreement with the public prosecutor on the admission of the offence and the criminal sanction, which must be accepted by the court. Whether it is favourable depends on the evidence and the circumstances of the case.

How long do criminal proceedings last?

It depends on the complexity of the offence, the number of defendants and the evidence. At the first meeting you receive an assessment of the likely course and timeline of the proceedings.

Corporate and commercial law

What is the fastest way to collect a debt from a company?

Often the fastest route is enforcement based on an authentic document, such as an invoice. Whether this is possible depends on the documentation you have.

Do I need a lawyer to set up a company?

It is not mandatory, but a properly drafted memorandum of association and an agreement between the founders prevent costly disputes later.

How much is a good contract worth?

Clearly defined obligations, deadlines, contractual penalties and the jurisdiction clause most often decide the outcome of a later dispute.

Civil law and damages

What is the deadline to claim compensation?

The general limitation period for damage claims is three years from learning of the damage and the person responsible, and at most five years from the occurrence of the damage; special time limits also apply.

What is non-pecuniary damage?

It is physical pain, mental anguish and fear suffered. The court determines the amount of compensation according to the circumstances of the case.

Do I have to go to court?

Not always. Many claims against insurers are settled out of court; court proceedings follow if the offer is not fair.

Employment law

What is the deadline to sue over a dismissal?

The deadline to bring a dismissal claim is 60 days from the delivery of the dismissal decision. That is why it is important to act immediately.

What if my employer does not pay my wages?

The payroll statement of wages the employer was obliged to pay is an enforceable title, so payment can be sought in enforcement proceedings and, if necessary, by a lawsuit. Employment claims become time-barred after three years.

How is workplace harassment proven?

Through correspondence, witnesses, medical records and a record of incidents. Note incidents in chronological order and submit a request for protection to the employer no later than six months after the last incident.

Family law

How long does a divorce by mutual consent take?

When there is a written agreement on the children and property, the procedure is usually quick and is often completed at a single hearing.

How is child support determined?

According to the child's needs and the parents' means; the court takes income and expenses into account.

Is property divided fifty-fifty?

The spouses' shares in marital property are presumed to be equal, but either spouse may prove that their contribution was greater.

Administrative law

What is the deadline to appeal a decision?

Under the General Administrative Procedure Act, 15 days from the delivery of the decision, unless a special law provides otherwise.

What is an administrative dispute?

Judicial review of final administrative acts before the Administrative Court. The action is generally filed within 30 days from the delivery of the act.

What if the authority stays silent?

When an authority fails to decide within the deadline, legal remedies for administrative silence may be used.

Constitutional law

What is the deadline for a constitutional complaint?

30 days from the delivery of the individual act, or from the action by which the right was violated.

Can I receive compensation for lengthy proceedings?

The Act on the Protection of the Right to a Trial within a Reasonable Time provides for an objection, an appeal and a claim for just satisfaction, which may include monetary compensation.

Is a constitutional complaint required before Strasbourg?

As a rule, yes: the European Court of Human Rights requires domestic remedies to be exhausted first.

Intellectual property

How long does trademark protection last?

Trademark protection lasts ten years from the filing date of the application and may be renewed an unlimited number of times.

Is a copyright work protected without registration?

Yes, copyright arises with the very creation of the work, but depositing the work can make it easier to prove.

What if someone copies my brand?

You may seek cessation of the infringement, removal of the products and compensation for damages.

International law

What is the deadline for an application to the ECtHR?

Four months from the final domestic decision.

Is an application to the ECtHR free of charge?

No court fees are charged in proceedings before the Court, but the application must be prepared professionally.

How is a foreign judgment recognised?

In special proceedings before the competent court in Serbia, which examines whether the statutory conditions are met.

Compliance

What is compliance?

It is a system of rules and procedures through which a company ensures that it operates in accordance with laws, regulations and its own internal policies.

Does a small company need to care about data protection?

Yes. The Personal Data Protection Act applies to every company that processes personal data of clients or employees, regardless of its size.

Who is subject to anti-money laundering rules?

Banks, exchange offices, accountants, real estate agents, digital asset service providers and others listed in the law. We check whether your company is among them.

Juvenile defence

Must a juvenile have a lawyer?

Yes. A juvenile must have a defence lawyer from the first interview, and the lawyer must have special knowledge of children's rights.

What is an educational order?

It is a measure that may be applied instead of conducting proceedings, for example an apology to the injured party or work in a humanitarian organisation, if the statutory conditions are met.

May parents attend the interview?

A parent or guardian is, as a rule, summoned and informed about the proceedings. What this looks like in a specific case we explain at the first meeting.

Crypto and digital assets

Are cryptocurrencies legal in Serbia?

Yes. Trading and investing in digital assets are governed by the Digital Assets Act, with rules on licensed service providers.

Is crypto profit taxed?

Income from the transfer of digital assets is taxed under the tax regulations. The amount and method of calculation depend on the specific case.

What should I do if I was defrauded on a crypto platform?

Keep all correspondence, wallet addresses and proof of payments, and contact a lawyer as soon as possible to file a report and secure assets.

AI and copyright law

Is AI-generated content protected by copyright?

Copyright protects human creativity. Whether and to what extent AI-assisted content is protected depends on the human contribution and the contract.

What is the EU Artificial Intelligence Act?

It is an EU regulation that governs AI systems according to their level of risk. It also applies to companies outside the EU when they offer their AI products on the Union market.

How do I protect my work online?

Keep evidence of the work's creation, mark authorship and terms of use, and in case of infringement request removal of the content and compensation.
